1. Agreement to these terms

These Terms of Service (the "Terms") are a binding agreement between you and Scent Wash ("Scent Wash", "we", "us" or "our"), a company based in Florida, United States. They govern your access to and use of scentwash.com, the Shop app storefront, our emails and text messages, and any purchase you make from us (together, the "Services"). By using the Services or placing an order you agree to these Terms, including the binding arbitration agreement and class action waiver in Section 14. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to purchase from us. We sell and ship within the United States only. By using the Services you confirm that you meet these requirements and that the information you give us is accurate and current.

3. Products and safe use

Scent Wash sells laundry detergent pods, dryer sheets and related household laundry products for personal, non-commercial use. Pods are concentrated detergent: keep them out of reach of children and pets, do not puncture or bite, and follow the directions on the box. Fragrance experience varies with water hardness, fabric, load size and drying method, and product images are illustrative. 4. Orders, pricing and payment

All prices are in U.S. dollars. The price you see is the price you pay: we do not add sales tax at checkout, and shipping is shown before you pay. An order is accepted only when we send a shipping confirmation. We may limit quantities, refuse or cancel any order, and correct pricing or description errors at any time, including after an order is placed; if we cancel an order that has been charged we will refund it in full. Payments are processed by Shopify Payments, Shop Pay and the other providers shown at checkout; installment options are offered and approved by the provider, not by Scent Wash.

5. Subscriptions and automatic renewal

When you select Subscribe & save you authorise us to charge your saved payment method on a recurring basis, at the cadence you choose (every 1, 2 or 3 months), at the discounted price shown at checkout, until you cancel. Each renewal ships on its billing date. You can swap fragrance or size, change the date, skip, pause or cancel at any time from your account or by emailing support@scentwash.com; changes made before a billing date apply to that delivery. There are no minimum terms or cancellation fees. If a list price changes we will email you at least 14 days before it applies. Our Subscription policy is part of these Terms.

6. Shipping, delivery and risk of loss

Shipping options, rates and timeframes are shown at checkout and in our Shipping policy, which is part of these Terms. Delivery dates are estimates. Title and risk of loss pass to you when the carrier accepts the package, except that we will replace or refund orders that arrive damaged or go missing in transit as described in our Refund policy. Optional order protection, when added to an order, is a service provided by Scent Wash under the terms shown in the cart.

7. Returns, refunds and guarantee

Our 30-day scent guarantee and our rules for damaged, lost or incorrect orders are set out in our Refund policy, which is part of these Terms. Because laundry products cannot be restocked once shipped, we do not accept physical returns; refunds under the guarantee are issued without a return.

8. Promotions, discounts and free gifts

Discount codes, automatic discounts, free gifts and other promotions are subject to the conditions shown when offered, cannot be combined unless we say so, have no cash value and may be changed or withdrawn at any time. Free digital items such as our Laundry Guide are licensed to you for personal use only and may not be resold or redistributed.

9. Accounts and communications

You are responsible for keeping your login details confidential and for all activity under your account. By providing your email address or phone number you agree to receive transactional messages about your orders and subscriptions. Marketing emails and texts are sent only with your consent and you can opt out at any time (reply STOP to texts or use the unsubscribe link in emails). Message and data rates may apply.

10. Reviews and content you submit

If you submit reviews, photos, videos, comments or other content ("User Content"), you grant Scent Wash a worldwide, non-exclusive, royalty-free, perpetual and sublicensable licence to use, reproduce, adapt, publish and display that content in connection with the Services and our marketing, in any media, and you waive any moral rights to the extent permitted by law. You confirm that you own or have the rights to the content, that it is accurate and not misleading, and that it does not infringe anyone's rights. We may remove any User Content at our discretion.

11. Copyright, trademarks and intellectual property

Copyright. The Services and all of their content, including text, photographs, videos, illustrations, packaging designs, page layouts, code, the Laundry Guide and other downloads, are © 2026 Scent Wash. All rights reserved. They are protected by United States and international copyright laws.

Trademarks. SCENT WASH™, the SW monogram, the tagline BE CLEAN. BE ICONIC. BE YOU.™, and the fragrance names CITRUS SERENADE™, MYSTIC OASIS™, SACRED EMBER™ and GOLDEN VEIL™ are trademarks of Scent Wash. Other names and logos that appear on the Services belong to their owners and are used for identification only. Nothing in these Terms grants you any right to use our trademarks, trade dress or packaging without our prior written permission.

Limited licence. You may view and use the Services for your personal shopping only. You may not copy, scrape, frame, modify, distribute, sell or create derivative works from any part of the Services, use our content or product imagery to sell or promote other products, or use any automated tool to access the Services without our written consent.

Copyright complaints. If you believe content on the Services infringes your copyright, send a notice that meets the requirements of the Digital Millennium Copyright Act (17 U.S.C. § 512) to support@scentwash.com with the subject line "DMCA notice".

12. Prohibited uses

You agree not to use the Services for any unlawful purpose; to resell our products commercially without a written agreement; to place fraudulent orders or abuse guarantees, promotions or free gifts; to interfere with the security or operation of the Services; or to impersonate any person. We may suspend or close accounts and cancel orders that violate these Terms.

13. Disclaimers and limitation of liability

Except for the express guarantees in our Refund policy, the Services and products are provided "as is" and "as available", and, to the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. To the fullest extent permitted by law, Scent Wash and its owners, employees and partners are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from the Services or any product, and our total liability for any claim is limited to the amount you paid us for the order giving rise to the claim. Some states do not allow certain limitations, so some of these may not apply to you.

14. Dispute resolution: binding arbitration in Florida and class action waiver

Please read this section carefully. It affects your legal rights.

Informal resolution first. Before starting any formal proceeding, you agree to email support@scentwash.com with a description of the dispute and the outcome you want, and to give us 60 days to resolve it with you informally. We will do the same by writing to the email address on your account.

Agreement to arbitrate. If the dispute is not resolved informally, you and Scent Wash agree that any dispute, claim or controversy arising out of or relating to these Terms, the Services or any product or order, including its existence, validity, interpretation or termination, and including claims based on contract, tort, statute, fraud or any other legal theory, will be resolved exclusively by final and binding arbitration, and not in court. This agreement is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.).

Rules and seat. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, before a single arbitrator. The seat and venue of the arbitration is Orange County, Florida, United States. Hearings, if any, will take place in Orange County, Florida, or by video conference if the arbitrator so orders or the parties agree; claims under $25,000 may be decided on written submissions. The arbitrator applies Florida law (without regard to its conflict-of-laws rules) and applicable federal law, may award any relief a court could award on an individual basis, and must issue a reasoned written decision. Judgment on the award may be entered in any court with jurisdiction. Arbitration fees are allocated under the AAA Consumer Arbitration Rules; if the arbitrator finds that a claim was filed for purposes of harassment or is patently frivolous, the arbitrator may reallocate fees.

Class action and jury waiver. You and Scent Wash agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. By agreeing to arbitrate, you and Scent Wash each waive the right to a trial by jury and the right to participate in a class action. If this class action waiver is found unenforceable as to a particular claim, that claim will be severed and heard by the courts named below, and the rest of this Section 14 remains in force.

Exceptions. Either party may bring an individual claim in small claims court in Orange County, Florida, if it qualifies. Either party may also seek injunctive or other equitable relief in court to protect its intellectual property rights.

30-day opt-out. You may opt out of this arbitration agreement by emailing support@scentwash.com with the subject line "Arbitration opt-out", your name, address and order number, within 30 days of your first purchase. Opting out does not affect any other part of these Terms.

Court proceedings. For any matter that is not subject to arbitration, you and Scent Wash agree to the exclusive jurisdiction and venue of the state and federal courts located in Orange County, Florida, and waive any objection based on inconvenient forum.

15. Governing law

These Terms and any dispute between you and Scent Wash are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

16. Indemnification

You agree to indemnify and hold harmless Scent Wash and its owners, employees and partners from any claim, loss or expense, including reasonable attorneys' fees, arising from your breach of these Terms, your User Content or your misuse of the Services or products.

17. General

These Terms, together with our Privacy policy, Shipping policy, Refund policy and Subscription policy, are the entire agreement between you and Scent Wash about the Services. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor of our business. We may update these Terms by posting a new version here with a new "Last updated" date; changes apply to orders placed after that date, and continued use of the Services after a change means you accept it.
